nowadays. According to Daniels 2004, accountability is known as assuming responsibilities for anyone actions. Nursing is a profession and the modern concept of accountability says that the nurses are the member of profession. Through the passing of nurse registration act (1919), nurses of Britain got the status of the accountable profession which tells that they were accountable legally for any work done by them and can be suspended or struck off for any unprofessional behaviour by them. To demonstrate professional accountability a regulatory body which is responsible for conducting and practicing of nurses created known as

NURSING AND MIDWIFERY COUNCIL.

To create a limit in nursing and midwifery practice on professional accountability is the main function of MNC.  In this case at the time of consideration,15-year-oldinvoluntary patient A   for 5 months due to self-harm, emotional deregulations and intense suicidal tendency in child and adolescent mental health unit in an NSW regional place.14-year-old patient B was admitted for four and half months in the unit with anorexia and periods in paediatrics unit when her weight was extremely low. 16-year-old patient C was admitted with suicide attempt which were drug based and spent 6 weeks there before discharged to drug rehabilitation system. All of the three patients were admitted in the unit of child and adolescent mental health unit.  On September 2nd 2015 and September 22nd 2015 patients stated that they were supplied with Phenergan on more than one time, had allowed patients to smoke, provide patients access to his phone, further investigations reflects giving cigarettes to patient, boundary violations which include making sexual remarks, giving accessed to patient to use mobile phone, disclosing personal information of any other staff, and also not intervening when witnessed a self-harming by patient.  The registered nurse was a 27-year-old practitioner Mr. Picones in February 2014 and in 2015 March he joined as registered nurse in child and adolescent mental health unit, all that poor professional accountability and wrong patient safety procedures were done by Mr. Picones.  Firstly, he denied all the allegations, excepting that he provided accessed to his mobile phone. In March2016 he left his employment there and in 2016 he took up employment in older persons mental and psychiatric emergency care unit in Nepean hospital without informing about that he was under investigations and practising under restrictions. Due to the copy of the local district health June 2016 provided to Nepean hospital , he was suspended for four months  and then after many hearings and further investigations the  cancellation of the registration under s 149C(1)(b) of the national law with instant effect from 5th April 2018 also not able to apply  for the review for 12 months from the date of order because he  changed his verbal and written statement frequently and said in statement of February 2018 that he was having a discussion with group during which he explained about Phenergan that people use to help them sleep and they asked to get it  for them but he hesitated and they said we won’t say it to anybody. By changing hisstatement, he misled the NSW health policies, health care records which was wrong and that was the main reason that why his registration was cancelled for 12 months. Under the Legislation cited- health practitioner regulation national law 2009 s 3A, s 139B, s 139E,class 7 and Sch 5D and 13(1). There are four pillars of professional accountability which includes professional,ethical, lawful and employment or contractual. According to NMC, professionally, the registered nurses are personally accountable for actions and omissions duringpractice and are always able to justify their decisions and whether laws relate to professional or personal practice, they must always act lawfully. Ethically, they must be aware of their own values, they are accountable to both criminal and civil court if they do not stand up for high standard of care with respect to religion, people values and education. Lawfully, have legal responsibility to have determined skill level and knowledge required for important task like taking temperature of patient. ERRORS DURING PATIENT SAFETY:

Patient safety is defined as those practices which reduces the adverse or harmful events which are related to exposure in medical care across the range of conditions or diagnoses. Patient safety practice is the cornerstone of good health care system. Thenurses and midwifery important to the coordination and surveillance which reduces harmful outcome. Patient safety was defined as the ‘prevention of harm to patients’ by the IOM. The root cause of errors or harms identified in following terms-

Latent failure:  Involve decisions which affect the policies, procedures, allocation of the resources and removed from the practitioner.

Organizational system failure: Failures which are indirect including organizational culture, protocols, external factor, knowledge transfer.

Active failure: Contact with patient directly.

Technical failure: Indirect failure of external resources or facilities.

CAUSE OF SUSPENSION:

By changing hisstatement, he misled the NSW health policies, health care records which was wrong and that was the main reason that why his registration was cancelled for 12 months. Under the Legislation cited- health practitioner regulation national law 2009 s 3A, s 139B, s 139E,class 7 and Sch 5D and 13(1). Court and tribunal decisions are important to sue a registered nurse for violation of rules and regulations. Tribunal’s decision relates concern or complaint regarding conduct, behaviour or performance of the practitioner of health. Court’s decision sometimesrefers to appeal of tribunals or mostly the outcome of statutory offence matter in court. And all of these records are found in AHPRA and NSW websites which helppractitioner to understand how the laws help them to practice ethically or safely,also show public that what is acceptable and what is not acceptable in care and -behaviour.

ACTIONS AND OMISSIONS:

The drug Phenergan is a strong antihistamine which provides a great sedating effect. It is used or given only by the advice of the practitioner or the doctor. Overdose of that Phenergan will cause death also. Mr. Picones had given Phenergan from the unit to the patients without any prescription, failed to make written records, also told patient a not to tell anyone that he supplied her Phenergan saying ‘I COULD LOSE MY JOB’. Also supplied cigarettes, not intervene when anyone tried to do self-harm, make sexual remarks, allowed patients to access his phone, also given drugs like temazepam, Valium, and tramadol when not prescribed, took photographs of other patient and discloses personal information about other staff. All these things show that he breached the nursing code of conduct and code of ethics based on all the matters. He also made many omissions in his written records and verbal sense like he said that I said not to tell anyone because I was in fear of losing my job. He also said that he made a sexual remark as joke to the patient, had not intervened when patient used his mobile phone. The registered nurse not intervened in self-harmingcondition during his duty hour. Here, in this case the breach of confidential matter occurred.  It occurs when the private or personal information of the patient is disclosed to the other parties or other person without his or her consent. The intentional breach which is seen in this case can result in significant poor or negative impact. The patient has had two solutions and the one is to sue that is cancel the registration for the monetary damage in civil law. Another consequence is criminal charges. Such charges will cause physical, emotional and the financial loss.

OTHER FACTORS LEADING TO ADVERSE OUTCOME:

There may be other factors like negligence by the other staff of the hospital in observing the work done by any other staff. There may be possibility of wrong arrangement of antihistamine drugs inthe hospital which created confusion to MR. Picones and he administered wrong medications each time. All of these conditions are only possibilities but here in this case it is totally seen that there are 0.1 percent chances of system-based error.  This case totally depicts that the registered nurse was doing wrong patient safety system. The registered nurse all time provided antihistamine drug to patient to avoid hard work, he gave antihistamine because it provides sedating effects to patient, he enjoyed doing his work illegally, he didn’t followed any law and all these happened also due to negligence of the other hospital authorities or the staff members, if all the other staff members will communicate with each other and help each other by observing each other work there will be less possibility of false patient safety and false professional accountability. It is also the duty of the doctor to check whether his or her patients are taking right drug or not, the pharmacists of the hospitals are also use to be very careful in giving any drug to the patient or the nurse or any other doctor without the countersigned in prescription by the doctor. And the most important thing that the patient or their relatives also need to be very careful about any illegal work in the hospitals. If all these things are also taken into consideration there would be no improper patient safety and professional accountability. Nowadays there are many laws and regulations which are to be followed by the registered nurses,if a nurse doing any of the following while practicing in healthcare service a report should be made-

Stealing, using alcohol or any other drug to the patient, falsifying records, abusing physically or sexually a patient, conducting any criminal activities.

METHODS TO AVOID ADVERSE EFFECTS:

If the nurses interested in safety measures, move into positions like safety officers, safety management teams then the above adverse events like condition is not created or seen. Registered nurses contribute to make safer organizations by becoming certified in patient’s safety.
