One of the key factors that motivate the employees the best is maintenance the health and safety in the work environment. It helps to improve working condition and increase the performance of the employees as well as the overall company by motivating the employees (Indakwa, 2013). Employees of Cooperative Group should be provided with healthy and safe work environment as this assignment is based on the study of health and safety of Cooperative group. Four key tasks of the assignment to be accomplished. The first task explains the legal requirements and regulations in order to ensure the health, safety and security of the employees of the organization. The second task describes the requirements for a healthy and safe workplace of the physical environment of Cooperative Group. The third task shows the roles and responsibilities for health and safety of key personnel in Cooperative Group. And the risk assessment about the work environment of Cooperative Group is the fourth and last task of the assignment.
In this task I have been asked to discuss health and safety regulation which employees of cooperative group should be aware of and how cooperative group should make sure employees are safe.
According to Health Safety Executive (2018), in the past health and safety in the workplace was very much the employer's responsibility. Now employees have more rights and responsibilities and the emphasis has shifted so that current health and safety focus on employers and employees working as a partnership to ensure that everyone is safe in the workplace. There are various explicit duties that an employer has towards their employees. For example, Cooperative Group must follow the statutory duties of employers and employees relating to health, safety and welfare, this is so the employers can provide things like maintenance, training and supervision relating to health and safety, they must also provide a safe place to work and provision and maintenance of safe access to the workplace. Cooperativbe Group must also follow their statutory duty. Which ensure that their employees have adequate welfare facilities. Employees also have specific duties that they have to follow by law which includes them to take reasonable care for health and safety for them and the people around them, they must also co-operate with the employer or any other person to enable the employer or other person to perform or comply with any legal requirements.
The health and safety regulations 1999 must also be followed by Cooperative Group, this regulation will protect employees in the workplace, It can also protect people not working by people who are working, this act states that if a business employs more than five people, they must at least have a written health and safety policy which consists of three parts. These three parts should contain aims and objectives for what will be achieved in terms of health and safety for the company (Jelimo, 2017). A organization chart that shows who is responsible for health and safety in the company and a system that will contain all necessary procedures for compliance with the relevant laws affect the company, e.g. risk assessment procedures, along with all risk assessments, a fire evacuation procedure and relevant training records.
The Manual Handling Operations Regulations 1992:-
The main provisions of these Regulations require employers to:
· avoid (so far as is reasonably practicable) the need for employees to undertake any manual handling activities involving risk of injury;
·make assessments of manual handling risks, and try to reduce the risk of injury. The assessment should consider the task, the load and the individual's personal characteristics (physical strength, etc.); and
· provide workers with information on the weight of each load.
The Provision and Use of Work Equipment Regulations 1998:-
The main provisions require employers to:
· ensure the safety and suitability of work equipment for the purpose for which it is provided;
· properly maintain the equipment, irrespective of how old it is;
· provide information, instruction and training on the use of equipment; and
· protect employees from dangerous parts of machinery.
The Reporting of Injuries, Diseases and Dangerous Occurrences Regulations 1995:-
Under these Regulations, employers are required to report a wide range of work-related incidents, injuries and diseases to the Health and Safety Executive (HSE), or to the nearest local authority environmental health department (Indakwa, 2013). The Regulations require an employer to record in an accident book the date and time of the incident, details of the person(s) affected, the nature of their injury or condition, their occupation, the place where the event occurred and a brief note on what happened. The following injuries or ill health must be reported:
· The death of any person;
· Specified injuries including fractures, amputations, eye injuries, injuries from electric shock, and acute illness requiring removal to hospital or immediate medical attention;
· 'Over-seven-day' injuries, which involve relieving someone of their normal work for more than seven days as a result of injury caused by an accident at work;
· Reportable occupational diseases, including:
o Cramp of the hand or forearm due to repetitive movement;
o Carpal tunnel syndrome, involving hand-held vibrating tools;
o Occupational asthma;
o Tendonitis or tenosynovitis (types of tendon injury);
o Hand-arm vibration syndrome (HAVS), including where the person’s work involves regular use of percussive or vibrating tools; and
o ccupational dermatitis;
· Near misses (described in the Regulations as 'dangerous occurrences'). The HSE has produced a list of the kinds of incidents regarded as 'dangerous occurrences'.
According to Health Safety Executive (2018), These Regulations implement two European Union directives on the organization of working time and the employment of young workers (under 18 years of age). The Regulations cover the right to annual leave and to have rest breaks, and they limit the length of the working week. Key protections for adult workers include:
· A 48-hour maximum working week. Employers have a contractual obligation not to require a worker to work more than an average 48-hour week (unless the worker has opted out of this voluntarily and in writing);
· Minimum daily rest periods of 11 hours, unless shift-working arrangements have been made that comply with the Regulations; and
· An uninterrupted 20-minute daily rest break after six hours' work, to be taken during, rather than at the start or end of the working time.
Extra protection is available to young workers (workers aged 15 to 18). In particular, young workers:
· Are entitled to a daily uninterrupted rest break of 30 minutes after working more than 4.5 hours;
· Are entitled to an uninterrupted 12-hour break in each 24 hour period of work.
· Are entitled to weekly rest of at least 48 hours in each seven-day period (and unlike adult workers, they cannot be made to take this rest over two days averaged over two weeks); and
· Cannot normally work more than eight hours a day or 40 hours a week. These hours cannot be averaged out. There is no 'opt-out' for young workers.
Cooperative Group must ensure safety and healthy environment to ensure safe and healthy working in the workplace. To make the work place healthy and safe the company should follow some rules and regulations in the workplace. The manager of the operations department is responsible for looking up any unhygienic condition or unsafety in the workplace
Falling objects- According to Health Safety Executive (2018), the objects or equipment that are heavy in use should not be kept at a height to ensure minimum accidents. Heavy objects should be stored in the ground places and light weight objects must be stored at the Hight in order to minimize the accidents. Items are to be organized in a form that prevents the likelihood of this happening.
Hand tools- Hand equipment, such as knives, pose a significant chance of injury for various types of business and employers should make certain that such tools are safely stored the manager should definitely in use (Jelimo, 2017). In industries where knives can be used, employers should get protective clothing to reduce injury.
Site Building works- The building can have work or repairs being done to it, while buildings around will need to have protective equipment put in place to protect employees, Gates and sign will warn anyone in the workplace who tries to pass the gate that there are people working on the site and they could get injured or trip over sharp object as they pass through (Millmosre, 2017).
Chemicals- According to McCunney (2012), at dome workplaces employees might have to use some kind of material which they might be hazardous to their health therefore the employer must reduce the possibilities by storing all chemicals in the correct place with instructions, ensuring all employees have protective equipment and making sure staff know how to use the equipment and dispose of it. Managers and employers must ensure that hazardous waste is identified at every stage of production and correct measures are taken to protect the health of employees and contractors who transport or dispose of waste.
Dampness and Mould- Water and Mould is a matter of great safety issue. Damp workplace hamper the workers to work efficiently and effectively. In the dump environment employees feel discomfort able in dealing the works (Millmosre, 2017). It also cause serious damage to the employees. Their Business should attempt to prevent Damp and Mouldy conditions inside the workplace by repairing certain regions of businesses when they desire too
Hygiene Facilities- According to Nzuve S. (2014), the work place should be hygienic and avoided unhygienic conditions. Business should follow the general welfare requirements that guarantee certain minimum levels of hygiene facilities in the work area. The workplaces have toilets and other facilities such as taps in place for employees which will ensure that they can keep hygiene.
Food Preparation Areas- The cooking area of the business should be maintained properly and adequately. This area should be kept clean and hygienic and may be used by employees from the business. Most businesses have cooking food areas which are close to the canteens for them to prepare food for that employers.
Evacuation assembly areas- Within the workplace a number of employees are already killed by heart or serious incidents for instance an explosion which is very rare, it is essential that every staff in any organization know what direction to go in case of a fire as well as other emergencies (Millmosre, 2017).
Noise and atmospheric pollution- The work environment should be free from any type of noise pollution so that the employees can work properly and appropriately. Noise and pollution hamper the smooth flow of work and make employees less efficient (Indakwa, 2013).
In an organization the key personnel are responsible for maintaining the health and safety of he working environment of the organization. This responsibility are- informing the health and safety representative or joint health and safety committee of any work-related accidents involving injury, death or occupational illness and providing the health and safety representative or joint health and safety committee with the results of any reports relating to health and safety in the workplace.
According to Health Safety Executive (2018), the joint health and safety committee meeting should be held in a specific location and the must specify the place to the employees of the organization. The employer must also choose the managerial member or members of the joint health and safety committee. These members must exercise managerial functions, and, if possible, do so at the workplace where the joint health and safety committee is located.
In the committee mitting is the recommendations are accepted then the employer must provide a written response to recommendations within 21 days. After that a timetable for action must be outlined and provided to the health and safety representative or joint health and safety committee. If an employer assumes to work against the recommendations then reasons must be given in writing. a health and safety representative have the same responsibilities and powers as a joint health and safety committee member (Jelimo, 2017). These include the responsibility to inspect the workplace at least once a month and the power to:
· identify workplace hazards
· be consulted about workplace testing
· make recommendations to the employer
· investigate work refusals and serious accidents
The roles and responsibility of some key personnel are as follows: -
Facilities Manager- According to Health Safety Executive (2018), the facility manager should exert his or her responsibility of maintaining the healthy and safe workplace for the workers of the organization. An individual employee has a responsibility in line with the Health and Safety at Work Act 1974. They must follow all policies, procedures, training, instructions in relation to their role and responsibility, safe use of equipment and carrying out practices relating to their job role. They must take reasonable care of their own actions and that of others around them in relation to health and safety. They must report health and safety matters and usually are the first to spot them; making their role an important one. Department heads are much lower down in the organizational structure when compared to the Facilities Manager and HR Director. Nevertheless, they still have a very important role and responsibilities with regards to health and safety. In most cases, instructions and guidelines for health and safety are passed down by other senior managers; to ensure procedures are correctly followed. They usually work with a checklist to ensure health and safety in their department.
Human Resources Director- The Human resources director is the key personnel who is responsible for recruiting, training, maintaining and also providing the healthy and safe workplace for the workers. They are basically responsible for staffing plans, training and development, budget, and labor relations. They promote and implement human resource values by planning and managing human resources programs.
Department heads- According to McCunney (2012), department heads are also responsible for maintaining the health and safety for the workplace as the workers are working in the supervision of the department heads. They are the key personnel who is the al in al for maintaining the healthy and safe workplace for the employees. They create and maintain specific policies and procedures for the employees. Department heads are given checklists to work from to ensure health and safety measures in their departments and if so, they can take action where necessary to correct defects and report serious issues.
