Legal and ethical issues in the nursing practices play a crucial role. Nursing practices and actions, in terms of health care needs is to be developed within their health care practices. On the other hand, knowledge on the ethical and legal issues, in the health care settings can help the health care professions to maintain their liability, in the nursing practices.
With consideration and practical knowledge of ethical issues and regulations, in the health care systems, the health care professions can enhance their skills and knowledge, in relation to the safety and autonomy of patients and self. In additional to that, proper delivery of treatment and care services to the service users of the health care can help them to enhance the quality of service user’s life.
While on the other hand, the communication bases the quality delivery of health care services and practices, with proper flow of knowledge. Communication can influence the care service delivery, in the health care organizations, in terms of delivering treatment and care services to the service users. Maintenance of ethical and legal issues or practices in the profession area of the health care professions can enhance and maintain the standards of nursing practices, with considering the accountability of health care professionals.
In order to enhance the safety and quality of health care service users, both the legal and professional issues, needs to be maintained, by the health care professionals. In the view of Rider et al. (2014), maintenance of the professional and legal framework, in the healthcare workplace can enhance morality, ethnicity and authenticity of the care settings. Moreover, the healthcare professionals can enhance their skills and knowledge, in relation to the legal frameworks, of different health care issues. As Mick et al. (2014), has commented that, improper practices, in terms of the professional issues, in the healthcare organization, can influence the health status of the service users in a negative manner.
In contrast of the professional issue identification, in the healthcare setting of the concerned case study, it has been found that, the health care organizations and health care professionals have evidenced, different professional issues. The major issue, in the given case study, which has been highlighted, is:
The concerned case study has demonstrated the ineffective communication relationship in the health care organization. As the baby, was treated with the gastroenteritis diagnosis at the beginning of the admission to the health care organization. However, it was later recognized that, the baby needs to be treated for the bowel obstruction. With lack of knowledge and communication with with the senior professions, the treatment went wrong. However, the codes of conduct, in the nursing practices, mention the need of effective communication and consultation among the health professions, in order to enhance the health quality of service users. In the opinion of Quan et al. (2013), the improper communication between the health care professionals, lead to dissemination of improper information, this leads towards the wrong and inappropriate treatment of the service users.
The case study has demonstrated that the communication gap between the health care professional, in the health care organization, lead to the death of child. Proper communication of the registered nurses with the other healthcare professionals could have saved the life of child.
The case study clearly highlighted the lack of training of the two registered nurses, who were allocated for delivering the care treatment for child. The registered nurses of the health care organization did not kept any clinical records and respond to the changes, which occurred in the child. Training, in the particular case study, can help the registered nurses to assist proper treatment, with consulting and communication.
In terms of the training, the organization and health care professionals need to follow the guidelines and rules of the Health Care Act 2008. As stated in the Act, it ensures the practical knowledge, skill and proper care delivery to the service users, by the health care professions. In addition to that, as Chou et al. (2014), has stated that, the Health Care Act, the health care professions need to be provided proper training and practices, before entering into the professional and practical hands. However, the case study has demonstrated that, the two registered nurses did not follow the professional code of ethics thus leading to critical situation of the child.
In addition to the above mentioned professional issues, another issue, which has been identified in the concerned case study, is safety of service users. The service users of the health care organization need to be delivered with safe and impregnable care settings. In the opinion of Brock et al. (2014), the health and safety policy maintenance, by the health care professions, ensures the safeguarding and minimal risks, of the service users. However, the concerned and given case study, did not assisted with the professional issue of safety of the service users. The two registered nurses need to have informed about the changes that were seen in the health status of the child however, lack of information and knowledge harmed the health of child, with leading to the situation of death.
The following case study has deployed the lack of accuracy in terms of care treatment delivery and dissemination of information. As Arnold & Boggs (2015), has commented that, the accuracy, in terms of information and care delivery settings, can lead towards the treatment in a wrong direction, which can deteriorate the health status of both service users and patients, in relation to accuracy. In the healthcare organization, the health care professionals need to ensure the precautions and the direction of treatment in proper direction, with accuracy. However, the registered nurses, in the case study, did not kept the professional issue of accuracy in treatment delivery to the child. In the opinion of Dykes et al. (2017), the nurses or the health care professionals, need to ensure and recheck the detailed and thorough report and records of the service users.
In contrast to that, the registered nurses, in the given case study, did not maintained the professional issue of record keeping, which could have taken the treatment and care delivery of the child, in a proper and ethical manner.
